Licentie van de pakketten

De pakketten zijn nog niet te koop. Dit zijn de voorwaarden waaronder wij ze willen verkopen; de definitieve tekst verschijnt op deze pagina zodra de verkoop van start gaat.

1. In het kort

Een licentie op een pakket wordt verleend aan het bedrijf dat het koopt, eenmalig en zonder vervaldatum. Het bedrijf mag het gebruiken in een onbeperkt aantal eigen projecten en projecten voor zijn klanten. Het mag de bestanden niet als dataset doorgeven. De officiële bronnen waarvan het pakket is afgeleid, moeten altijd worden vermeld.

2. Wie de licentie heeft

De licentiehouder is het bedrijf dat op de factuur staat. De licentie geldt voor zijn werknemers en voor de opdrachtnemers die voor het bedrijf werken, op een onbeperkt aantal computers en servers. Zij is niet overdraagbaar, behalve samen met de gehele onderneming.

3. Wat u mag doen

De bestanden gebruiken in websites, applicaties, softwareproducten, rapporten, drukwerk en video, ook voor commerciële doeleinden.
Ze wijzigen: vereenvoudigen, samenvoegen, herprojecteren, opnieuw opmaken, koppelen aan uw eigen gegevens.
De werken die u ermee maakt (een kaart, een applicatie, een dashboard) aan uw klanten leveren, met de grenzen die het werk nodig heeft.
De grenzen aan de gebruikers van uw applicatie aanbieden, voor zover de applicatie ze nodig heeft om ze te tekenen of te bevragen.
De gekochte editie voor altijd blijven gebruiken, zonder verdere betaling.

4. Wat u niet mag doen

De bestanden van het pakket, of bestanden die daaruit zijn omgezet, doorverkopen, sublicentiëren, publiceren of delen als dataset of als download, tegen betaling of kosteloos.
Een dienst aanbieden die hoofdzakelijk tot doel heeft de grenzen aan derden te verstrekken (een grenzen-API of een tegeldienst die voor anderen openstaat).
Het pakket aan een klant of aan een ander bedrijf geven zodat die het zelfstandig gebruikt: zij hebben een eigen licentie nodig.
De bronvermelding verwijderen of verbergen.

5. Bronvermelding

Elk pakket is een afgeleid werk van officiële open datasets: wij hebben de grenzen vereenvoudigd, de eenheden opnieuw gecodeerd en de tabellen samengesteld. De licenties van die datasets vereisen dat de bron wordt vermeld overal waar de gegevens worden gepubliceerd, en deze verplichting gaat op u over. Elk pakket bevat een bestand ATTRIBUTION.md met de exacte formulering; een regel als “Grenzen: adminboundaries.com, op basis van gegevens van Istat” naast de kaart of in de credits volstaat. De uitgevers van de bronnen onderschrijven de pakketten niet.

6. Onze bestanden en de oorspronkelijke gegevens

Dit zijn twee verschillende zaken, en deze licentie behandelt ze verschillend.

De oorspronkelijke datasets, zoals hun uitgevers ze vrijgeven, blijven open: iedereen kan ze bij de bron verkrijgen en ze gebruiken of verspreiden onder de eigen licentie van de bron. Deze licentie beperkt ze niet.
De bestanden van het pakket zijn gegevens die wij hebben gegenereerd of verrijkt: grenzen die zo zijn vereenvoudigd dat de niveaus op elkaar aansluiten, identificatiecodes, vertaalde namen, oppervlakten, labelpunten, buren, historische tabellen, SVG-bestanden en voorbeelden. Deze mogen volgens artikel 4 niet worden verspreid.

7. Geen garantie

De grenzen zijn gegeneraliseerd en hebben geen officiële of juridische waarde: zij zijn niet geschikt om grenzen, eigendom of rechtsbevoegdheid vast te stellen. Het pakket wordt geleverd in de staat waarin het zich bevindt; DWMP S.r.l. is uitsluitend aansprakelijk tot het daarvoor betaalde bedrag, behalve waar de wet deze beperking niet toestaat.

8. Beëindiging en toepasselijk recht

De licentie eindigt als deze voorwaarden worden geschonden en de schending niet binnen 30 dagen na onze kennisgeving wordt hersteld; de bestanden moeten dan worden verwijderd. Op de licentie is Italiaans recht van toepassing en de rechtbank van Modena is bevoegd.
